A sharp constitutional standoff intensified Friday after the Supreme Court of the United States issued a stern warning to the Trump administration following President Donald Trump’s decision to move forward with a sweeping 10% “global tariff” despite a recent 6–3 ruling declaring he lacks authority under a specific emergency powers law to impose such broad trade measures.
A Direct Challenge to the Court
In its earlier decision, the Supreme Court ruled that the emergency statute cited by the administration does not grant the president unilateral power to levy across-the-board tariffs without congressional authorization. The majority opinion emphasized that trade policy and taxation powers are constitutionally vested in Congress, and that emergency authorities cannot be interpreted so broadly as to override that framework.
Despite the ruling, President Trump on Friday signed an executive order implementing a 10% tariff on a wide range of imported goods, describing the move as necessary to protect American industry and national security.
Legal analysts say the decision to proceed anyway raises serious constitutional questions.
