The Trump administration’s tariff policy is facing major legal challenges. Trump claimed he had the authority to impose tariffs on foreign countries without Congress, using the International Emergency Economic Powers Act (IEEPA). However, the Supreme Court of the United States ruled that the law does not give the president the power to impose tariffs, declaring those tariffs unconstitutional.
Now several companies are taking legal action. One major case involves Nintendo, the Japanese video-game giant behind franchises like Super Mario, The Legend of Zelda, and Pokémon. Nintendo has filed a lawsuit in the United States Court of International Trade, demanding a full refund of tariff money it paid since February 2025, plus interest.
Other companies, including Costco, have also filed similar lawsuits. The controversy has sparked a broader debate about presidential power versus congressional authority in trade policy. Supporters argue tariffs protect domestic industries, while critics say tariffs function as taxes and therefore must be approved by Congress.
As these lawsuits move through the courts, they could redefine how much economic power a U.S. president can exercise without legislative approval.
